Goodluck Jonathan May Be Sworn-In Next Week

Nigeria may be facing a constitutional crisis next year. According to legal experts, the 33 day absence of Pres. Umar Musa Yar’Adua has presented Nigeria a dilemma that may eventually result in a crisis if it continues. No one knows when the president will return to Nigeria. According to top security sources, no Nigerian besides Turai Yar’Adua knows the president’s state of health. Confirming this one security source said, “if anybody tells you they know Yar’Adua’s state of health the person is lying. Our people are around the hospital but it’s only Turai who has seen him.”

On Thursday next week the tenure of Justice Kutigi as the Chief Justice of Nigeria (CJN) will expire. By the 1999 constitution of the Federal Republic of Nigeria, only the president can swear in the new Chief Justice of Nigeria. Legal experts posit that Goodluck Jonathan, Nigeria’s vice president cannot swear in Justice Katsina Alu as the new CJN. And if the president does not return to work on or before Thursday Nigeria will not have a chief justice.

If for any reason the president is not able to return to work before Thursday, Goodluck Jonathan cannot be sworn in as president since Nigeria would not have a chief justice. According to the constitution, only the CJN can swear in the new president. This, some lawyers we spoke with suggest is the making of a “perfect constitutional crises.”

One security source we suggested this scenario to said, “This is a very scary scenario. We may end up having a vice president and no president, a supreme court without a chief justice. You know what, if anybody brings a letter purporting to be a letter from Pres. Umar Musa Yar’Adua handing over government to Goodluck Jonathan it will be a forgery. The man left no such letters behind and right now nobody believes he is in a position to sign a letter. This is perfect storm. Nigeria we hail thee!”

There are secret moves to avert the pending constitutional crises. According to several sources, the only way to avert this crisis is to swear in Goodluck Jonathan as the new president before Thursday next week. “I can tell you that there’s almost an agreement that Jonathan will be sworn in next week to complete the remaining 18 months of Yar’Adua’s first term. Jonathan will content himself with serving 18 months as president. I guess any talk about him seeking his own term will be dealt with by the Peoples Democratic Party (PDP) and the Nigerian people.”(nigeriancommunity.net)

Already, some serving ministers and appointment seekers have been reaching out to the Vice President and some Niger Delta leaders. Elendureports.com was given names of some ministers who are making overtures to prominent Niger Delta leaders who are known to have very close relationship with the Vice President.

There are also some misgivings about the yet to be inaugurated Jonathan presidency. This reporter spoke with some people in the media and security about what the Jonathan presidency will look like. “Quite frankly there’s not going to be much difference between Yar’Adua and Jonathan presidency,” said a media practitioner who spoke to us. One security source told us, “Nigerians don’t really know Goodluck Jonathan. They will know the real Jonathan when he becomes president. Wait and see.”

Some others we spoke to believe the Vice President has benefitted from low expectations of him. “These guys who say things about Goodluck don’t really know him. He is very smart and politically astute. Don’t let his quiet demeanor deceive you. He may yet be the surprise savior this country has been waiting for.”
